INSIGHTEC Ltd. (“INSIGHTEC”, “We” or “Us”) is committed to protecting the privacy of information that users of its website (“User” or “You”) at www.insightec.com and other websites owned, operated, licensed or controlled by INSIGHTEC Ltd. (the “Site”) share with it.  This privacy policy (“Privacy Policy”) explains the types of personal information we may collect from Users, why we collect it, and with whom we may share it.  It also describes how we protect your personal information and how you can contact us with any questions.  This Privacy Policy applies to personal information we collect from Site visitors as well as personal information we may gather outside this Site, such as through mobile applications, social media and written correspondence with Insightec.  Capitalized terms which are not defined herein, shall have the meaning ascribed to them in our Terms of Use at http://www.insightec.com/terms-of-use/, into which this Privacy Policy is incorporated by reference.

1. Your Consent (PLEASE READ CAREFULLY!)

BY ENTERING, CONNECTING TO, ACCESSING OR USING THE SITE, YOU AGREE TO THE TERMS AND CONDITIONS SET FORTH IN THIS PRIVACY POLICY, AND THE ACCOMPANYING TERMS OF USE.  IF YOU DO NOT AGREE TO ANY TERM PROVIDED HEREIN, PLEASE DO NOT ACCESS OR USE THE SITE.

2. Information We May Collect

We may collect two types of data and information from our Users:

a. One type of information is non-identifiable web usage information (“Non-Personal Information”) which we collect through your use of the Site.  Non-Personal Information which may be gathered consists of information about your browser type and language, referring and exit pages and URLs, visit date and time, amount of time spent on particular pages, sections of the Site visited, etc.  Non-Personal information may be collected using various technologies such as cookies, web beacons and/or third party web analytic tools, to analyze website traffic.  We may aggregate Non-Personal Information to better understand how visitors use our Site and to improve it.  We may also disclose aggregated user information to third parties for lawful purposes. 

b. The second type of information is individually identifiable information, such as name, postal address, and telephone number (“Personal Information”), which is provided consciously and voluntarily by the User.  The Personal Information is collected from the details the User provides in the Contact Form, such as the User's full name, country, e-mail address, phone number (optional) and any text he/she voluntarily writes in the "message" box.  Additionally, the User may be requested to provide his/her name, e-mail and company name when he/she requests to download articles or brochures from the Site, and in doing so, Personal Information is collected.

Except for IP address (or media access control (“MAC”) address as applicable), which Users of the Site automatically provide mainly for enhancing the User’s experience and for geolocation and security purposes, we do not collect any Personal Information from you or related to you when you use the Site unless you provide us with the Personal Information voluntarily.  When you voluntarily submit your Personal Information to us, you are giving us your consent to the collection, use and disclosure of your Personal Information as set forth in this Privacy Policy and in the Terms of Use. 

3. How We Use and Share the Information

We use the Non-Personal Information and Personal Information (collectively, the “Information”) to operate the Site, for statistical and research purposes, for customization and improvement of our Site (e.g. enhancing the Users' experience by analyzing trends and Users' preferences) and in order to offer future commercial services.

Also, we may use the Personal Information to:

• Be able to contact Users to provide technical assistance and support.

• Provide Users who subscribe to our newsletter with updates.

• Send Users commercial content or advertisements.

• Determine general geolocation information (i.e., country) from which the User's computer is connected to the Internet in order for us to know the general location of our Site's Users as well as in order to safeguard our Site.

• Verify the User's identity for the purpose of dealing with inappropriate interactions.

We will not share Personal Information we collect with any third party, except as follows:  (a) to comply with applicable law, regulation, legal process, subpoena or governmental request; (b) to enforce this Privacy Policy and/or the Terms of Use, including investigation of potential violations thereof; (c) to detect, prevent, or otherwise address fraud, security or technical issues; (d) to respond to claims that any content available on the Site violates the rights of third parties; (e) to protect the rights, property, or personal safety of INSIGHTEC, its Users, or the general public; (f) when INSIGHTEC is undergoing any change in control, including by means of merger, acquisition or purchase of all or substantially all of its assets; (g) to collect, hold, store and/or manage your Personal Information through INSIGHTEC's authorized third party service providers (including, as applicable, their affiliates as necessary to provide us with the requested services), as reasonable for business purposes, which may be located in a country that does not have the same data protection laws as your jurisdiction; and/or (h) pursuant to your explicit approval prior to the disclosure.

For avoidance of doubt, INSIGHTEC may transfer and disclose Non-Personal Information to third parties at its own discretion as described above.

4. Deletion or Modification of Personal Information

If for any reason you wish to delete or modify your Personal Information please send us an e-mail with adequate detail of your request to info@insightec.com, and we will make reasonable efforts to modify or delete any such Personal Information pursuant to any applicable privacy laws.  Note that unless you instruct us otherwise we may retain your Personal Information for as long as reasonably required for the purposes for which such Personal Information was collected, including without limitation, for future analytics and analysis, in order to comply with our legal or business requirements or obligations, to resolve disputes, or to enforce our Terms of Use, all as permitted under any applicable privacy laws.  Aggregated and/or anonymous information derived from your use of the Site may remain on our servers indefinitely.

5. Minors

We do not knowingly solicit, collect or use Personal Information from children under the age of thirteen (13).  We reserve the right to request proof of age at any stage so that we can verify that minors under the age of thirteen (13) are not using the Site.  If we learn that we collected Personal Information from children under the age of thirteen (13) we will endeavor to delete that information as quickly as possible.  Please contact INSIGHTEC at: info@insightec.com if you have reasons to suspect that INSIGHTEC collected Personal Information from children under the age of thirteen (13) and we will endeavor to delete that information as quickly as possible.

6. Security

We take commercially reasonable administrative, technical and physical security measures to maintain the security and integrity of our Site and User Personal Information and protect against loss, misuse, or improper access through generally accepted industry standard technologies and internal procedures.  Please note, however, that there are inherent risks in transmission of information over the Internet or other methods of electronic storage and we cannot guarantee that unauthorized access or use of your Personal Information will never occur.

7. Third Party Service Providers

We may be using third party software or service, in order to collect, store and/or process the information detailed herein.  INSIGHTEC uses commercially reasonable efforts to engage with third parties that post a privacy policy governing their collection, processing and use of non-personal and personal information.  However, INSIGHTEC does not control such third party service providers.  Please read their terms of use and privacy policies to understand their privacy practices.

8. Tracking Technologies

When you access or use the Site, INSIGHTEC may and may allow authorized third party service providers to place or recognize industry-wide technologies such as cookies and/or other tracking technologies ("Tracking Technologies").  Such Tracking Technologies are stored on your computer.  Tracking Technologies may enable, inter alia, automatic activation of certain features, and make your experience and usage simpler, convenient and effortless.  We and our third party service providers may use both session cookies (which expire once the User closes the browser) and persistent cookies (which stay on the User's browser and may be used by the browser on subsequent visits to the Site, unless deleted by the User).  Some browsers have a “Do Not Track” feature that lets a user have the browser notify websites that the user does not want to have his or her online activities tracked.  INSIGHTEC’s website currently does not respond to such browser-initiated signals.

9. International Data Transfer

We may transfer information collected about you, including Personal Information, to affiliated entities, or to other third party service providers (as provided herein) across borders and from your country or jurisdiction to other countries or jurisdictions around the world.  Please note that we may transfer such information to a country and jurisdiction that does not have the same data protection laws as your jurisdiction, and you consent to such transfer of information.

10. Direct Marketing

You hereby agree that we may use the e-mail address which you provided us with for the purpose of sending company news, newsletters, product announcements and such, informing you of certain updates or our new products or services.  You may withdraw your consent via sending a written notice to INSIGHTEC by e-mail to the following e-mail address: info@insightec.com.

California residents who have an established business relationship with INSIGHTEC may choose to opt out of our sharing your Personal Information with third parties for direct marketing purposes.  If you are a California resident and (1) you wish to opt out, or (2) you wish to request certain information regarding our disclosure of your Personal Information to third parties for direct marketing purposes, please contact us as set forth below.

11. Changes to the Privacy Policy

The terms of this Privacy Policy will govern the use of the Site and any information collected therein.  INSIGHTEC reserves the right to change this policy at any time, without prior notice, to reflect technological advancements, legal changes, and/or good business practices, so please re-visit this page frequently.  If INSIGHTEC changes its privacy practices a new Privacy Policy will reflect those changes and the effective date of the revised Privacy Policy will be set forth in this paragraph.  This Privacy Policy was last updated on May 27, 2015 and is effective as of that date.
